Know Your Rights: School Discipline 2026

About This Guide

This comprehensive FAQ helps Texas parents understand their rights and how to advocate for their child in the new school discipline landscape created by legislation (known as HB 6) that passed in 2025. It covers changes to in-school and out-of-school suspensions,  emergency placements, disciplinary alternative education programs, and expulsions.

This guide is intended solely for educational purposes and does not constitute legal advice. If you need specific legal guidance, you may reach out to our team of education attorneys by emailing info@texasappleseed.org or consult with other education attorneys and advocacy organizations.

WORDS TO KNOW

  • ISS: in-school suspension
  • OSS: out-of-school suspension
  • DAEP: disciplinary alternative education program
  • JJAEP: juvenile justice alternative education program
  • Emergency placement: a rapid placement into an alternative educational setting, such as a Disciplinary Alternative Education Program (DAEP), due to a student's behavior or a crisis situation that threatens safety or the educational environment

Where can I find my school’s specific discipline policies?
Each school district must have a Student Code of Conduct that clearly outlines its discipline policies. You can typically find this on your district’s website, or you can request a copy from the main office, principal, or campus behavior coordinator. The code of conduct must be updated to reflect HB 6 requirements.
